歡迎您使用“幫拖”應用程式(下稱“本 APP”)。本 APP 由[幫拖軟件科技有限公司](下稱“本公司”、“我們”)提供。本《服務協議》(下稱“本協議”)是您(下稱“用戶”、“您”)與本公司之間具有法律約束力的協議,規定了您使用本 APP 及其相關服務(下稱“本服務”)的條款。
在使用本 APP 前,您必須同意並接受本協議的所有條款。如您不同意本協議的任何內容,
請立即停止使用本 APP。
1. 定義
• “老闆”:指通過本 APP 發佈任務並願意支付報酬以換取服務的用戶。
• “承包商”:指通過本 APP 接受並完成任務以獲取報酬的用戶。
• “任務”:指由老闆通過本 APP 發佈的具體工作需求,包括但不限于搬家、維修、
送貨、電腦支援等。
• “報酬”:指老闆為任務完成而同意支付給承包商的金額。
2. 帳戶註冊與資格
• 您必須年滿 18 歲並具有訂立具法律約束力合約的充分法律能力,方可使用本 APP。
• 您需提供準確、真實、最新及完整的資料進行註冊。
• 您有責任對您的帳戶和密碼保密,並對您帳戶下發生的所有活動承擔全部責任。
3. 服務性質
• 本 APP 僅作為一個中立的線上平台,為老闆和承包商提供聯繫、溝通與交易的便利。
• 本公司並非老闆或承包商的僱主、僱員、代理人或合作夥伴。 老闆與承包商之間是直接的服務合約關係。
• 本公司不對任務的質量、安全性、合法性或準確性作出任何保證,亦不參與雙方之間的具體交易糾紛,但會提供爭議解決機制協助處理。
4. 用戶義務與行為準則
• 老闆承諾:
o 發佈的任務內容必須合法、安全、明確,且不涉及任何違反香港法律或公序良俗的行為(如非法運送物品、危險工作等)。
o 需準確描述任務詳情、時間、地點及報酬。
o 在承包商完成任務後,應及時確認並支付約定的報酬。
• 承包商承諾:
o 具備完成任務所需的相應技能、資格及體能。
o 應以專業、勤勉的態度提供服務。
o 不得要求老闆支付協議報酬以外的款項。
• 所有用戶均不得:
o 發佈虛假、欺詐、騷擾性或侵犯他人權利的資訊。
o 試圖繞過本 APP 的平台進行私下交易以逃避費用。
o 從事任何可能損害、癱瘓或過度負載本 APP 基礎設施的行為。
5. 報酬與支付
• 報酬由老闆在發佈任務時設定。• 本公司可能提供通過第三方支付處理商的在線支付服務。所有支付行為均受該第三方之條款及隱私政策規管。
• 在承包商完成任務並經老闆確認後,報酬將在扣除本公司之平台服務費(如有)後支付給承包商。
• 雙方應注意可能產生的稅務責任,並自行負責申報及繳納根據香港稅務條例(如《稅務條例》)可能適用的任何稅項。
6. 取消與爭議解決
• 如任務開始前需要取消,用戶應盡快透過本 APP 通知對方。
• 對於已完成或進行中的任務所產生的爭議,用戶應首先嘗試友好協商解決。
• 若協商未果,用戶可透過本 APP 的爭議申訴機制要求本公司介入調解。本公司的最終決定對雙方均具有約束力。
• 本公司保留暫停或終止涉及爭議之用戶帳戶的權利,直至爭議解決為止。
7. 責任限制
• 本公司對因使用本 APP 而引致的任何間接、偶然、特殊或後果性損失(包括利潤損失、資料損失)概不負責。
• 本公司對本服務的總體責任(如有)就任何單一事件或一系列相關事件而言,以就該事件向本公司支付之服務費總額為限。
• 本條款受香港法例允許的最大限度規管。
8. 個人資料(隐私)
• 本公司根據香港法例第 486 章《個人資料(私隱)條例》收集、使用及保護您的個人資料。
• 我們的《隐私政策》說明了我們如何處理您的個人資料,並構成本協議的一部分。請仔細閱讀。
9. 協議修改與終止
• 本公司有權隨時修改本協議。修改後的協議將在本 APP 上公佈。若您於修改後繼續使用本服務,即表示您接受經修改的協議。
• 您或本公司均可根據本 APP 內提供的程序終止您的帳戶。
• 終止後,本協議中依其性質應持續有效的條款(如知識產權、責任限制、隱私等)將繼續有效。
10. 管轄法律與爭議解決
• 本協議受香港特別行政區法律管轄並按其解釋。
• 任何因本協議引起的或與其相關的爭議,應首先通過友好協商解決。若協商失敗,雙方同意將爭議提交香港國際仲裁中心(HKIAC)並按其仲裁規則進行仲裁。
11. 整體協議
• 本協議連同本 APP 內提及的《隐私政策》及其他政策,構成您與本公司之間就本服務的完整協議。

Part 2: English Version
IMPORTANT NOTICE: PLEASE READ THIS AGREEMENT CAREFULLY
Welcome to the “Aider” mobile application (the “App”). The App is provided by [AIDER TECH. LIMITED] (“Company”, “we”, “us”, “our”). This Service Agreement (“Agreement”) is a legally binding agreement between you (“User”, “you”) and the Company, governing your use of the App and its related services (the “Services”).
BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE APP.
1. Definitions
• “Poster”: refers to a User who posts a Task through the App and offers to pay a Reward in exchange for services.
• “Helper”: refers to a User who accepts and completes a Task through the App to earn a Reward.
• “Task”: refers to a specific job or need posted by a Poster via the App, including but not limited to moving, repairs, delivery, IT support, etc.
• “Reward”: refers to the amount of money a Poster agrees to pay a Helper for the completion of a Task.
2. Account Registration and Eligibility
• You must be at least 18 years old and possess the full legal capacity to enter into a binding contract to use the App.
• You must provide accurate, truthful, up-to-date, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account and password and are fully responsible for all activities that occur under your account.
3. Nature of the Service
• The App acts solely as a neutral online platform to facilitate connections, communication, and transactions between Posters and Helpers.
• The Company is not the employer, employee, agent, or partner of either Posters or Helpers. The relationship between a Poster and a Helper is a direct service contract relationship.
• The Company makes no warranties regarding the quality, safety, legality, or accuracy of any Tasks and does not participate in the specific transactions between users. However, a dispute resolution mechanism is provided to assist in handling issues.
4. User Obligations and Conduct
• Posters Agree to:
o Post Tasks that are legal, safe, clear, and do not involve any activities that violate Hong Kong law or public policy (e.g., transporting illegal items, dangerous work).
o Accurately describe the Task details, time, location, and Reward.
o Promptly confirm completion and pay the agreed Reward once a Helper has completed the Task.
• Helpers Agree to:o Possess the necessary skills, qualifications, and physical ability to complete the Task.
o Perform services professionally and diligently.
o Not solicit any payment from Posters outside of the agreed Reward.
• All Users agree NOT to:
o Post false, fraudulent, harassing, or infringing content.
o Attempt to circumvent the App’s platform to arrange off-platform transactions to avoid fees.
o Engage in any activity that may damage, disable, or overburden the App’s infrastructure.
5. Rewards and Payment
• The Reward is set by the Poster when posting the Task.
• The Company may provide online payment services through third-party payment processors. All payments are subject to the terms and privacy policy of such third parties.
• Upon Task completion and confirmation by the Poster, the Reward will be released to the Helper, minus the Company’s platform service fee (if applicable).
• Users are responsible for being aware of and fulfilling any potential tax liabilities arising from their transactions under the Inland Revenue Ordinance (Cap. 112) or other applicable Hong Kong tax laws.
6. Cancellation and Dispute Resolution
• If a Task needs to be cancelled before commencement, the user should notify the other party as soon as possible via the App.
• For disputes arising from completed or ongoing Tasks, users should first attempt to resolve the matter through good-faith negotiation.
• If negotiation fails, users may request the Company’s intervention through the App’s dispute resolution mechanism. The Company’s final decision shall be binding on both parties.
• The Company reserves the right to suspend or terminate the accounts of users involved in a dispute until the matter is resolved.
7. Limitation of Liability
• The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data) arising from the use of the App.
• The Company’s aggregate liability for any event or series of connected events shall be limited to the total service fees paid to the Company in relation to the event(s) giving rise to the liability.
• This clause is subject to the maximum extent permitted by Hong Kong law.
8. Personal Data (Privacy)
• We collect, use, and protect your personal data in accordance with the Hong Kong Personal Data (Privacy) Ordinance (Cap. 486).
• Our Privacy Policy, which is incorporated into this Agreement by reference, explains how we handle your personal data. Please read it carefully.
9. Modification and Termination
• The Company reserves the right to modify this Agreement at any time. Themodified agreement will be posted on the App. Your continued use of the Services after such posting constitutes your acceptance of the changes.
• You or the Company may terminate your account pursuant to the procedures provided within the App.
• Upon termination, provisions of this Agreement which by their nature should survive (e.g., intellectual property, limitations of liability, privacy) shall continue to apply.
10. Governing Law and Dispute Resolution
• This Agreement is governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
• Any dispute arising out of or in connection with this Agreement shall first be resolved through friendly negotiation. Should such negotiation fail, the dispute shall be submitted to the Hong Kong International Arbitration Centre (HKIAC) for arbitration in accordance with its rules in force at the time of applying for arbitration.
11. Entire Agreement
• This Agreement, together with the Privacy Policy and other policies referenced within the App, constitutes the entire agreement between you and the Company regarding the Services.
